How judicial management works
Judicial management (Part 7 of the IRDA) is Singapore's corporate rescue procedure. A licensed insolvency practitioner takes over the management of the company with the aim of saving the business as a going concern, securing a scheme with creditors, or achieving a better realisation of assets than an immediate winding up would bring.
A judicial manager can be appointed by court order or, since the IRDA, by a resolution of creditors without going to court. While the company is under judicial management a moratorium protects it from most enforcement action, giving the judicial manager room to put a proposal to creditors.
